Terms of Service

*ALL participants are required to complete a waiver, which includes a RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, and DECLARATION OF FITNESS

Reservation Policy

• Must be at least 21 years old to participate.
• Full payment is due in order to reserve a place on the tour(s).
• Cancel before 48hrs of your tour to receive a full refund.
• No refunds within 48hrs of your tour.
• No refunds if ID is not present or valid at time of departure.

Refunds

* Fox Hill Adventures LLC will return refunds and will attempt to notify participants
using the contact information provided within the reservation.

Debit or Credit Card Purchases: Refunds for debit or credit card payments will be issued as a credit to the original bank or credit card used to pay. In the event that a customer has cancelled this card, they will need to contact their card company to have the funds released. We cannot issue refunds to any card other than the one used to pay.
Money Orders, Cashier’s Check, or Local Check Purchases: FHA will mail a check for refunds of money order, cashier’s check, or for local check payments to the address provided by the participant within the reservation. You may update the address at the time you request the refund. Dependent on mail delays, it may take up to 14 business days for the check to arrive.

Photo Release Policy

You agree that Fox Hill Adventures LLC may copyright in its own name, use, re-use, and reproduce any images, photos or videos that you send to us, or that are taken by our guides and/or other travelers of you individually or in a group, in any medium, including but not limited to print, electronic media, or internet, free of charge and without your right to inspection, for promotion and publicity purposes worldwide related to our travel products and services.

Alcohol Policy

Fox Hill Adventures LLC can not allow alcohol consumption while in the tour van!
*If alcohol consumption disrupts or disturbs other participants on the tour, a warning will be given by FHA staff. If a second occurrence of disorderly behavior occurs due to alcohol consumption, Fox Hill Adventures LLC staff reserves the right and authorization to cancel the remainder of the participant’s trip, with no refund. The participant at fault will be responsible for their own travel accommodations back to location of tour departure, and assume all costs associated with their travel.

Smoking Policy

Fox Hill Adventures LLC understands that you have the right to smoke at your own risk. Smoking on a FHA tour is permitted, but we ask that you take into the consideration of other participants. Please be considerate of others!
(i) Please do not smoke near other participants without permission. Please do not smoke near or around FHA equipment, or present other reckless smoking behavior.
Failure to follow the above policy regarding smoking will result in your removal from the trip along the same standards of the Behavior and Conduct Policy below.

Illegal Drug Policy

Fox Hill Adventures LLC prohibits the possession, distribution, sale, and use of illegal drugs while attending its tours in accordance with federal, state and local laws.
Failure to follow the above policy regarding illegal drugs will result in your removal from the trip along the same standards of the Behavior and Conduct Policy below.

Conceal & Carry Policy

Fox Hill Adventures LLC, for the safety of its staff and participants, has the right to know if a participant has a “Conceal & Carry” permit. Please inform FHA staff if you will be invoking your right to carry a permitted firearm on any trip.

Behavior and Conduct Policy

Fox Hill Adventures LLC enjoys meeting new people and is all about individual expression. We ask that you remain respectful of other participants while on this tour.
If a participant displays undesirable behavior or disrespect towards other participants, FHA staff, other vender staff, or public, Fox Hill Adventures LLC reserves the right and authorization to cancel the remainder of the participant’s tour.
If a participant is removed from a tour due to misconduct, the participant being removed is responsible for finding their own travel accommodations back to Ironwood, MI and assume all costs associated with their travel.

Limitation of Liability

Fox Hill Adventures LLC is itself an adventure and touring business. We do not assume responsibility for acts or omissions of third-party businesses, including but not limited to, food and beverage services, federal/state/county/city/private owned property, etc.
To the fullest extent of the law, any liability for loss, death, injury, or damage, which you or your travelling party may incur (directly or indirectly) in relation to, or coming from your participation with Fox Hill Adventures LLC, or breach of booking conditions is excluded. You, as a participant, release Fox Hill Adventures LLC, and our officers, employees, agents, and representatives from any liability and waive claims that you may have in connection with your participation with Fox Hill Adventures LLC. Any condition or warranty which would be implied by the law into booking conditions is excluded.
To the extent an implied warranty cannot be excluded, our liability is limited to, at our discretion, (i) A tour substitution; (ii) A transfer to a similar tour of equivalent value; (iii) A refund of the total amount received by Fox Hill Adventures LLC from you in connection with the booking of your reservation.
Claims made by participants are excluded to the extent it is for indirect/consequential loss, loss of profits, economic loss, or for indirect special punitive or exemplary damages.
