Terms of Service
*ALL participants are required to complete a waiver, which includes a RELEASE OF LIABILITY,
WAIVER OF CLAIMS, ASSUMPTION OF RISK, and DECLARATION OF FITNESS
Age and Health Requirements
- Age: To participate on a Fox Hill Adventure, an individual must be at least 21 years of age. A current picture identification with date of birth must be presented at the time of departure. If one cannot be presented, then the participant will have to forfeit their reservation without refund.
(i) Age Exception Clause: A picture identification is not required if the FHA trip was already a pre-arranged family tour; exceptions were granted by FHA and approved by the other participants on the tour; or for a custom tour.
- Health: There are many opportunities that endure physical activity on the tours; mild to strenuous hiking, biking, paddling, etc. It is your responsibility to ensure you are healthy enough and suitably fit to participate fully in trip activities. It is also your responsibility to obtain medical advice for the health requirements/recommendations for your trip destinations. If you fail to do so, and suffer personal injury as a result, we hold no liability to you or your travelling party for any loss/damage, which may incur.
*(i) Proof of medical insurance must be presented either via email, or text as soon as possible or at the time of departure. A copy of medical insurance must be available for FHA. If a copy is not available, FHA has the right to make a copy to have on hand in case of a medical emergency. If the participant(s) fails to provide proof of insurance, the participant(s) will have to forfeit their reservation without refund.
(ii) Health Advisement: Many of the kayaking outfitters used by FHA have a 250 pound weight restriction, and the equipment used by FHA has weight limits of 300 pounds. If a participant identifies themselves as reaching or surpassing these weights, we recommend that you contact FHA to make optional/alternative arrangements. FHA would like everyone to have the opportunity to join and participate in the trip activities and does have equipment and options to accommodate.
Equipment Policy
- Fox Hill Adventures has most of the equipment you need, but not all. To participate on a Fox Hill Adventures trip, we recommend bringing the following:
1 duffle bag or suitcase, 1 day-bag or backpack, a sleeping bag/blanket, and a pillow. We also recommend looking over the FHA pre-trip checklist for other useful trip amenities. - Please note that FHA’s equipment does not include bicycles, kayaks, paddle boards, canoes, or any other activity-based equipment.
Though these items can be rented by third-party venders during the trip for an additional charge. - FHA can accommodate some personally owned equipment. If a participant chooses to use their own equipment (bicycles, kayaks, canoes, or paddle boards), please notify Fox Hill Adventures via email so we can determine storage needs.
- (i) FHA will have travel racks, cables and locks to secure participant’s personally owned equipment, but it is still recommended for participants to have their own security amenities for when they are not with FHA staff.
- (ii) Participants that bring their own personal equipment, do so at their own risk. Fox Hill Adventures LLC is not liable or financially responsible for any damage or theft for personally owned equipment brought along by participants.
- (iii) Personal equipment should be included under participant’s own home-owner’s insurance.
- Fox Hill Adventures LLC will not permit open water kayaking or canoeing on Lake Superior or Lake Michigan without a certified ACA (American Canoe Association) guide or personally have an ACA certification to present to FHA staff.
Food Policy
- Please notify FHA via email as soon as possible of any participants with food allergies.
- FHA can accommodate vegetarians. Though food will be prepared using the same cookware that food with meat and gluten products will be cooked with.
- If you require vegan or gluten-free accommodations, there are many opportunities to stop along the travel route for grocery options.
FHA will have limited non-meat cookware, and welcomes you to utilize storage space needed for your vegan/gluten-free food options. - If you require special food accommodations and need to utilize storage space and/or need to stop along the travel route, please notify FHA via email, or phone ahead of time to allow us to plan accordingly.
- *Unfortunately, FHA cannot discount a trip if a participant opts out of any of the prepared meal plans.
Alcohol Policy
- Fox Hill Adventures LLC is grateful for your participation on this trip. We would love to kick back and share a beverage at the end of a long day of adventuring. All we ask is that you know your limits and keep your alcohol consumption to no more than a 3-drink maximum within 24 hrs.
- *If alcohol consumption disrupts or disturbs other participants on the trip, a warning will be given by FHA staff. If a second occurrence of disorderly behavior occurs due to alcohol consumption, Fox Hill Adventures LLC staff reserves the right and authorization to cancel the remainder of the participant’s trip, with no refund. The participant at fault will be responsible for their own travel accommodations back to Ironwood, and assume all costs associated with their travel.
Smoking Policy
Fox Hill Adventures LLC understands that you have the right to smoke at your own risk. Smoking on a FHA trip is permitted, but we ask that you take into the consideration of other participants. Please be considerate of others.
(i) Please do not smoke near other participants without permission. Please do not smoke near or around FHA equipment, or present other reckless smoking behavior.
(ii) You must dispose of butts properly. Do not leave smoking trash anywhere, but in the garbage!
(iii) Failure to follow the above policy regarding smoking will result in your removal from the trip along the same standards of the
Behavior and Conduct Policy below.
Illegal Drug Policy
- Fox Hill Adventures LLC prohibits the possession, distribution, sale, and use of illegal drugs while attending its tours in accordance with federal, state and local laws.
- Failure to follow the above policy regarding illegal drugs will result in your removal from the trip along the same standards of the
Behavior and Conduct Policy below.
Conceal & Carry Policy- Fox Hill Adventures LLC, for the safety of its staff and participants, has the right to know if a participant has a “Conceal & Carry” permit.
Please inform FHA staff if you will be invoking your right to carry a permitted firearm on any trip.
- Fox Hill Adventures LLC, for the safety of its staff and participants, has the right to know if a participant has a “Conceal & Carry” permit.
Behavior and Conduct Policy
- Fox Hill Adventure staff enjoys meeting new people and is all about individual expression. We do ask that you remain respectful of other participants
while on this trip. - If a participant displays undesirable behavior or disrespect towards other participants, FHA staff, other outfitter/vender staff, or public,
Fox Hill Adventures LLC reserves the right and authorization to cancel the remainder of the participant’s trip. - If a participant is removed from a trip due to misconduct, the participant being removed is responsible for finding their own travel accommodations back to Ironwood, MI and assume all costs associated with their travel.
Trip Expectation Policy- If a participant decides to depart from a trip early due to medical reasons, behavior misconduct, or for other reasons, the participant will not receive a partial refund and will assume all cost and responsibility of finding their own travel back to Ironwood, MI.
- Fox Hill Adventures LLC asks all participants to help participate in campsite set-up, tear-down, meal prep, and meal cleanup.
- *FHA may have shuttle service options that can be accommodated, at an additional cost to the participant(s) leaving a trip early.
Reminder Policy
- If your trip is not completely paid 74 days prior to the date of your trip, Fox Hill Adventures LLC has the right to send you a reminder email regarding the balance due.
- 14 days prior to the date of your trip Fox Hill Adventures may send you an email regarding a packing list and a reminder about your upcoming trip.
